  1. Introduction; Acceptance of Terms

These Employee Terms of Service (“Terms”) govern your access to and use of the Ando worker application, websites, mobile services, and related features (collectively, the “Employee App” or “Services”) provided by Methodic Labs, Inc. (“Ando,” “we,” “our,” or “us”). By creating an account, logging in, or using the Employee App, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree to these Terms, you may not use the Employee App

  1. Nature of the Employee App

The Employee App is a tool used by individuals (“Workers”) whose employer uses Ando for availability, scheduling, and workforce management. Workers may view schedules, update availability, manage their profile, and enable optional job‑discovery visibility. Ando is not an employer and does not control employment decisions. Schedules, assignments, wages, and workplace conditions are determined exclusively by each Employer.

  1. Eligibility

To use the Employee App, you must be at least 16 years old, legally authorized to work, and authorized by an Employer that uses Ando. All information you provide must be accurate and current.

  1. No Employment; No Joint Employment; No Scheduling Control; No Cross‑Employer Coordination

Ando is not an employer, joint employer, co‑employer, staffing agency, labor broker, or employment intermediary under federal, state, or local law, including the Fair Labor Standards Act (FLSA), National Labor Relations Act (NLRA), the NLRB’s 2023 Joint Employer Rule, or any predictive scheduling laws. Your employment relationships exist solely between you and each Employer for whom you work.

Ando does not hire, fire, discipline, supervise, direct, or control your work; does not set wages or hours; and does not provide payroll, training, benefits, tax withholding, or workplace policies. All such matters are controlled exclusively by your Employer.

Ando does not issue, approve, modify, or control employee schedules. Schedules shown in the Employee App are generated, approved, and finalized solely by Employers. Ando may provide forecasting tools or recommendations to Employers under enterprise agreements, but Employers decide whether to accept, modify, or disregard such output.

AI‑generated suggestions or matches based on availability are informational only. They are not guarantees or promises of shifts, earnings, roles, or hours.

If you work for more than one Employer, those relationships are independent. Ando does not coordinate schedules, hours, or decision‑making across Employers. Ando does not share one Employer’s operational data or scheduling decisions with another Employer.

Employers are responsible for all employment‑related compliance, including wage‑and‑hour laws, labor laws, safety requirements, predictive scheduling laws, and any penalties or obligations arising under them.

  1. Worker Accounts; Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify Ando immediately if you suspect unauthorized access. You agree not to share your credentials, attempt unauthorized access, or misrepresent your identity.

  1. Availability, Preferences, and Scheduling

You may enter availability, preferences, and time‑off requests. These do not guarantee scheduling outcomes. Employers retain full control and discretion over shift assignments and scheduling decisions.

  1. Job‑Discovery Visibility (Optional)

Job‑discovery visibility is optional and off by default. If you enable it, you may allow participating Employers to view limited information to consider you for additional roles. Enabling visibility does not guarantee opportunities. You may disable visibility at any time.

  1. Communications

By using the Employee App, you consent to receive scheduling notifications, workplace messages, security alerts, and operational communications. Message and data rates may apply.

  1. Data Practices; Privacy

Your use of the Employee App is subject to the Ando Privacy Policy, available at https://ando.work/privacy. The Privacy Policy explains how information is collected, used, and retained, as well as your rights and choices. By using the Employee App, you consent to our data practices.

  1. Account Deletion

You may permanently delete your Ando account at any time via Settings → Account → Delete My Account, which links to https://dashboard.methodic.work/data-deletion. Account deletion is permanent once confirmed.

  1. Prohibited Conduct

You may not misuse the Employee App, including by interfering with security features, attempting unauthorized access, introducing malicious code, scraping data, or using the App for unlawful purposes.

  1. Intellectual Property

The Employee App and its content, software, designs, and related intellectual property belong to Ando. You receive a limited, non‑transferable license to use the Employee App for lawful purposes.

  1. Third‑Party Services

The Employee App may integrate with third‑party systems such as communications tools or payroll processors used by Employers. We are not responsible for third‑party services or their terms.

  1. Disclaimers

The Employee App is provided “as is” and “as available.” Ando disclaims all warranties to the maximum extent permitted by law, including warranties of merchantability, fitness for a particular purpose, and non‑infringement. We do not guarantee hours, earnings, scheduling outcomes, job opportunities, or App availability.

  1. Limitation of Liability

To the maximum extent permitted by law, Ando is not liable for indirect, incidental, consequential, punitive, or special damages, including lost wages or lost earnings. In no event will Ando’s total liability exceed one hundred dollars (US $100).

  1. Employment‑Related Disputes

Employment‑related disputes, including wages, hours, discipline, workplace conduct, predictive scheduling compliance, or safety, are solely between you and your Employer. Ando is not responsible for resolving employment disputes.

  1. Arbitration; Class Action Waiver

All disputes between you and Ando will be resolved through individual, binding arbitration under the Federal Arbitration Act and AAA Consumer Rules. You waive any right to participate in class or representative actions. You may opt out within 30 days by contacting legal@ando.work.

  1. Governing Law; Venue

These Terms are governed by the laws of the State of California. Any dispute not subject to arbitration will be heard exclusively in the state or federal courts located in San Francisco County, California.

  1. Changes to These Terms

We may update these Terms periodically. Continued use of the Employee App constitutes acceptance of any updated Terms.
