Ando Technologies, Inc. ("Ando," "we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and protect your personal information when you use our website located at https://www.ando.work/ (the “Website”), mobile application (the “App”), and in providing our autonomous labor scheduling services, labor demand forecasts, other related services (collectively with the Website and App, the "Services"). By accessing and using our Website, App, and/or Services you freely and expressly consent to the collection, use, and disclosure of your personal information as set out in this Privacy Policy.

We may collect personal information when:

  • You visit our Website or App.

  • Use our Services.

  • Register and/or login through or Website or App.

  • Interact on social media such as liking, commenting, or direct messaging our profiles.

  • Use our web features such as when you access interactive tools, quizzes, or other digital features on our Website or App.

Information you provide:

We collect personal and non-personal information that you provide directly or that is automatically collected when you use our Services. This may include:

  • Company-provided Information: Employee name and email address

  • Employee Account Information: Name, email address, phone number, company name(s), job title(s), gender, date of birth, profile photo, and password when you create an account.

  • Employee Scheduling Availability: Information provided by the employee about work availability for scheduling purposes. 

  • Employee Employment and Education Information: Information about employee’s employment history, role experience, qualifications, education, availability patterns, and compensation ranges.

  • User-Provided Content: Images, photos, or other content that you upload to our Services.

  • Communication Data: Information provided when you contact us for support, respond to surveys, or interact with our customer service.

  • Recruitment and Talent Management Information: Details contained in letters of application and resume/CV (previous employment background, education history, professional qualifications, language and other relevant skills, and certifications), information necessary to complete a background check, details on performance management ratings, driver’s license information, shift history, role experience, availability patterns, compensation ranges, and other information used to populate employee biographies associated with a worker profile or Ando Passport.

Information we automatically collect:

  • Usage Information: IP address, device information, and browsing activity when you use our website or mobile app.

  • Cookies & Tracking Data: Collected through cookies and similar tracking technologies.

Information from third parties:

  • When you interact with our website or through our brand on a social media platform, we may collect certain information that you make available to us such as website metadata, your social media account ID, your social media ‘likes’, click-throughs to our Website or App, or custom interactions. We may combine this information with information provided by third party data providers in order to communicate, advertise, or market our Services to you.

We may also make inferences about you such as your interests that we believe are relevant to you and your household based on the information we have collected.

  1. How We Use Your Information

We use the information collected for the following purposes:

  • Service Provision & Enhancement: To operate, improve, and personalize our Services, including to providing AI-powered employment scheduling intelligence, labor intelligence, the Ando Passport, and recruiting services.

  • Communication: To communicate with users including updates, and service-related announcements (subject to user preferences).

  • User-Generated Content Management: To store, display, and facilitate sharing of images and other uploaded content.

  • Security & Fraud Prevention: To protect against unauthorized access, fraud, and abuse.

  • Customer Support: To respond to inquiries and provide our users with support.

  • Marketing: To send promotional content, and otherwise market our Services.

  • Legal Compliance: To comply with applicable laws, legal obligations, and law enforcement requests, as well as collect amounts owing to us and maintain business records.

  • With Consent: We may otherwise use your information with your consent.

We may disclose your information with your consent. We also disclose your information with our corporate affiliates, as well as vendors or service providers who:

  • Help us communicate with you. 

  • Manage and optimize our Website, App, and Services.

  • Provide artificial-intelligence powered features. Ando uses various third-party artificial intelligence tools to enable our Services, including but not limited to OpenAI, Anthropic, Google LLC.   • Provide marketing and advertising services (see ‘Use Of Cookies And Tracking Technologies’ for more information on your choices with these services)

In addition, we may disclose your information:

  • To protect the legal rights of our company, employees, agents, and affiliates.

  • To protect the safety and security of our users.

  • To detect and protect against fraud.

  • When required by law or to protect our rights and users. For example, we may be required to disclose personal information in response to lawful requests by public authorities, including to meet law enforcement requirements or a court order, subpoena, or other judicial, administrative, or investigative proceedings.

  • As part of a business transition. For example, if we are involved in a merger, sale, or asset transfer.

Ando operates a multi-employer platform designed to connect users (employees or members) with employment opportunities. As part of the Services, employees have the ability to choose whether or not to share pertinent employment-related data with employers and other platform users. This includes, but is not limited to:

  • Work history data, such as start date, end date, number of shifts completed, and job roles assigned.

  • Job preferences and availability, including the types of roles sought and the hours a user is available to work.

  • Compensation data related to earnings associated with past roles performed through the Ando platform.

  • Geo-location data, which may be used to match users with nearby job opportunities.

If a user does not provide consent, no identifying information will be shared with employers or other platform users.

We may disclose de-identified, aggregate, or anonymous information for any purpose. For example, we may disclose de-identified, aggregate, or anonymous workforce intelligence to employers. This means that the information we disclose does not identify specific individuals, nor is combined with other data to protect your privacy.

  1. Your Privacy Choices

You have the right to exercise the following choices with our use of your personal information:

  • Access the personal information we maintain about you. 

  • Delete the personal information we maintain about you. Please note we may be required by law to retain certain information in compliance with accounting, tax or other legal obligations.

  • Correct inaccurate personal information we maintain about you.

  • Opt out of certain uses of your personal information, notably tailored advertising using cookies or emails: Refer to our ‘Cookies and Tracking Technologies’ section below for your choices.

  1. Use of Cookies and Tracking Technologies

Like many companies, we use cookies, pixels, and other tracking technologies to collect information about your browsing activities and your interactions with our Website, App or emails. We currently do not enable the use of third-party pixel tags or cookies for advertising purposes, but may do so in the future. Please check back periodically if you would like to review and/or opt out of these future uses.

  1. Mobile Privacy

Our App uses software code provided by our business partners (software development kits or SDKs) that let our software interact with the services those partners provide. Sometimes these interactions will involve that business partner collecting some information from the device on which the software is run.

  1. Retention

We will retain your personal information only for as long as it is necessary for the purposes of fulfilling our Services or otherwise as described in this Privacy Policy, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

We maintain reasonable safeguards to protect against unauthorized access, use, modification, and disclosure of personal information in our custody and control. Despite our efforts, we cannot guarantee that unauthorized access or use will never occur. It is important that you take steps to keep your information safe and secure. Choose an account password that is hard for others to guess and don’t reveal it to third parties. If you use a shared public computer, do not opt to have your login ID or password remembered and be sure to log out of your account when you finish.

In addition to the rights granted above, if you are a resident of the above states, you may have the right to:

  • Opt out of the ‘sale’ or ‘share’ of your personal information for targeted advertising. We do not ‘sell’ or ‘share’ your personal information for monetary benefit. However, some third party cookies placed on our Website may be considered a ‘sale’ or ‘share’ under these privacy laws. You may opt out of such cookies as detailed in ‘Use Of Cookies and Tracking Technologies’ section (above). 

  • Sensitive personal information. We only collect sensitive personal information which is necessary for us to provide our Services. As such, limiting our use of your senstivie personal information would result in us not being able to provide our Services.

Appeal:

If we deny your privacy request, you may appeal that decision by emailing us at privacy@ando.work. We will respond to your appeal within a reasonable period of time and as required by law. If, after we have processed your appeal, you are still unsatisfied with our response, you have the right to file a complaint with your state attorney general.

Authorized Agent: 

If you are an authorized agent submitting a request on behalf of another person, you must provide a copy of a lawful power of attorney or written authorization from the consumer (along with proof of your identity). If you make a request as an authorized agent, you will receive additional instructions. Depending on the type of request, we may contact you or the consumer on whose behalf you claim to act to verify your authorization.

Right to Non-Discrimination:

We do not discriminate against customers who exercise any of their rights described in our privacy policy.

Controller/Business Designation:

We operate as a ‘Controller’ (and a ‘Business’ under CCPA) on behalf of our account holders. In limited circumstances, we operate as a ‘Processor’ (and a ‘Service Provider’ under CCPA) on behalf of employers whose employers are not registered Ando account holders.

Residents of the (“UK”) and European Economic Area (“EEA”) are provided certain privacy rights under the UK and EU General Data Protection Regulations (“GDPR”).

Those countries may not have equivalent data protection laws as the country in which you provided the data. When we transfer your data to other countries, we will protect the data as described in this Privacy Policy and applicable supplemental product privacy policy and comply with applicable legal requirements providing adequate protection for the transfer of data to countries outside the EEA or UK.

If you are located in the EEA or UK, we will only transfer your Personal Data if the country to which the Personal Data will be transferred has been granted an adequacy decision or we have put in place appropriate safeguards in respect of the transfer, for example we have entered into the Standard Contractual Clauses adopted by the European Commission and required additional safeguards with the recipient, or the recipient is a party to binding corporate rules approved by a supervisory authority.
